Consignor Terms and Conditions 

{ Simply }

~ Items must be clean, tag-free, preferably in working condition and ready-to-sell.
~ All consignors give the Auctioneer all rights to the representation, description and all matters relating to the offering of items for sale unless otherwise specified, in exchange for the agreed-upon percentage of sale.
~ Unsold or withdrawn items must be removed promptly or are subject to storage fees, sale or disposal by Mrs. Huizenga with all terms and conditions still applicable.
~ All items sold as-is and all sales final.

{ The Fine Print }

The Auctioneer, or Auction House wherever it is used, means Hookerson-Blough or Mrs. Huizenga. Mrs. Huizenga refers to the business and not to a sole person or representative.

The Consignor is the person or business named in the Consignment Agreement as the person or business from which the Lot has been received for auction.

These Terms and Conditions represent the terms which the Auctioneer/Auction House contracts with the Consignor and acts in its capacity as an agent on behalf of the Consignor. The Terms and Conditons between Auction House and buyers remain separate and are clearly stated elsewhere. This agreement supersedes and takes precedence over any previously agreed Terms and Conditions of business between the Auctioneer and Consignor.

Commission:

This is the agreed-upon amount paid by the Consignor to the Auction House on the sale of a lot, calculated on the hammer price at the rates specified in writing below, plus any applicable taxes.

The Lots:

The Auctioneer reserves the right to determine the date of sale; whether any lot is suitable for sale, the manner in which the sale is conducted, the descriptions of the lot and any other matters related to the sale of the lot.

The Auctioneer reserves the right to partition any property delivered by the Consignor to  be placed in the auction into Lots, described by number, for sale either on its premises via Auction or the “Buy it Now” option at a reasonable price; or in an after-sale at a reasonable price.

The auctioneer also reserves the right to reject, rescind, or combine any Lots consigned at any point after consignment. Any “Reserve” prices—amounts at which the item is protected against sale—are either at the Auctioneer’s discretion or must be determined at the time of accepting the item.

The Auctioneer has the right to regulate and control the bidding and to advance the bids in whatever intervals he considers appropriate for the Lot in question.

While the Auctioneer will attempt to describe correctly each lot to be sold, guarantee is not made of the correctness of the description, the physical condition, authenticity, attribution, and no statement shall be deemed such a warranty, representation or condition; and no sale will be set aside on account of any imperfections not noted.

Each lot is sold “as is”, “where is” and without recourse. The onus is on the bidder to review the lot during preview, or to arrange for prior examination of auction items.

The Auctioneer has the right to refuse any bid and to advance the bidding at his absolute discretion. The highest bidder accepted by the Auctioneer shall be the Buyer. If any dispute shall arise between bidders, or in the event of doubt on the part of the Auctioneer as to the bid, the Auctioneer may, at his discretion, determine the successful bidder; he may re-offer the lot; or he may strike a bid.

If the Auctioneer decides that any opening bid is too low, he may reject the same. The Auctioneer reserves the right to withdraw any lot from the sale or to divide any lot, or to combine any two or more at his sole discretion.

The Consignor may withdraw any lots at any prior to one business day preceding the sale with consent of the Auction House, but must remove the items from the premises at that time, otherwise service or storage fees may apply.

Unsold lots must be collected or arrangements made to deliver or store within 48 hours, or storage fees may apply.

The Auction House reserves the right to either reject further sale of such items or to offer items for after-sale at a reasonable price. Items are subject to any agreed-upon service fees and applicable taxes.

Items to be consigned are to be delivered not more than five days prior to sale unless by prior arrangement, or storage fees may apply.

The Auction House is not responsible for any default by the Buyer.

The Auction house reserves the right to use images of the items and prices realized in promotion, advertisement or for reference for future auctions.

Consignors who are registered bidders shall not bid on their own items.

Payment to Consignors is based on the agreed-upon terms below, provided the Buyer has paid for the item.
